§1 Information about the Seller
The owner of the online store is:
Anna Kisicka-Turkuła, operating under the brand Anna Luxury Art, hereinafter referred to as the “Seller.”
The Store offers and sells artistic products via the website.
These Terms & Conditions define the rules governing the use of the Store and the conditions for concluding sales agreements.
Use of the website, browsing its content, and placing an order constitutes acceptance of these Terms & Conditions.

§2 Definitions
For the purposes of these Terms & Conditions, the following definitions shall apply:
Store – the online store operated by the Seller
Customer – a natural person, legal entity, or organizational unit making a purchase in the Store, regardless of the purpose of the purchase
Product – an item offered for sale
Made-to-order Product – a product individually produced after purchase
Original Artwork – a work based on a fine art print, finished by hand by the artist
Partner – an entity cooperating with the Seller
The provisions of these Terms & Conditions apply to all Customers, subject to mandatory legal provisions applicable in the Customer’s country of residence.

 
§3 Nature of Artistic Products
The products offered in the Store are works of art.
They may include:
– fine art print
– hand-applied gilding
– original artistic finishing
Each work is unique.
Variations may occur in:
– color
– structure
– texture
– finish
Such variations are a natural characteristic of the artwork and do not constitute a defect.

 
§4 Artistic Interpretation
The products are not industrially manufactured goods.
The visual materials presented in the Store are for illustrative purposes only.
The final result may differ from the presented visuals.
Individuality and uniqueness are inherent and integral features of each artwork.
Such differences do not constitute grounds for complaint.

 
§5 Orders
Orders are placed via the Store’s website.
The sales agreement is concluded upon successful completion of payment.
Full payment is required as a condition for order fulfillment.
The Seller reserves the right to refuse to process an order in the event of:
– technical errors
– pricing errors
– payment issues
– suspected abuse or fraudulent activity

 
§6 Production and Order Fulfillment
The Seller does not maintain stock of finished products.
All products are individually made after the order is placed.
Production may be carried out by external production partners cooperating with the Seller.
Production may take place at a location closest to the Customer’s delivery address.
The fulfillment time depends on:
– the type of product
– the selected size
– the level of finishing
– the country of delivery

 
§7 Shipping
The Store provides both domestic and international shipping.
Delivery times are indicative and may vary.
The Seller shall not be liable for delays caused by:
– courier service providers
– customs procedures
– circumstances beyond the Seller’s control

 
§8 Customs Duties and Import Charges
For international orders, additional charges may apply, including:
– customs duties
– VAT
– import taxes
– administrative fees
These charges are determined by the authorities of the destination country.
The Seller has no control over the amount of such charges.
The Customer is fully responsible for their payment.

 
§9 Packaging and Receipt of Shipment
Products are professionally secured for transport.
The Customer is obliged to inspect the shipment immediately upon receipt.
In the event of visible damage, it is strongly recommended to prepare a damage report with the courier.

 
§10 Damage in Transit
If the Customer receives a damaged shipment, the Customer is required to:
– prepare photographic documentation of both the packaging and the product
– retain the original packaging
– report the damage without delay
The report must be submitted within:

Failure to submit the report or provide the required documentation may result in rejection of the complaint.
The Seller submits transport-related claims to the carrier or insurer.

 
§11 Returns and Complaints
1. Nature of the Products and No Returns
All products offered in the Store are individually made to order (made-to-order).
The Seller does not maintain inventory — each order is produced specifically upon request.
Therefore, the Customer is not entitled to withdraw from the contract.
By placing an order, the Customer acknowledges and accepts that returns and order cancellations are not possible once production has commenced.

2. Complaints – Damage
Complaints apply exclusively to damage occurring during transport.
Photographic documentation and retention of the original packaging are required.
Transport-related complaints are submitted by the Seller to the carrier.

3. Limitations on Complaints
Complaints must be submitted within the time limit specified above.
Failure to report within the required timeframe may result in rejection of the complaint.
This is due to the fact that courier companies and insurers require damage claims to be reported within a short and strictly defined period from the moment of delivery.
Exceeding this deadline prevents the Seller from effectively pursuing claims with the carrier or insurer.
For this reason, the reporting deadline is essential and binding for the complaint process.

4. Artistic Character
Differences resulting from the artistic nature of the work do not constitute grounds for complaint.

 
§12 Unclaimed Shipments
In the event that a shipment is not collected, the Customer shall bear the cost of re-shipping.
The Seller reserves the right to deduct logistical costs incurred.

 
§13 Visuals and Colors
Product colors may vary depending on the device and screen settings.
Such differences do not constitute grounds for complaint.

 
§14 Materials and Technique
Products may contain natural and artistic elements.
Variations are permissible and constitute an inherent feature of the artwork.

 
§15 Certificate of Authenticity
Selected artworks may include a certificate confirming their authenticity.

 
§16 Copyright
All copyrights to the artworks remain the property of the artist.
The purchase of a product constitutes acquisition of the physical item only.
Copying, reproduction, or any use of the artwork without prior consent of the artist is strictly prohibited.

 
§17 Cooperation and Use of the Works
Partners, including but not limited to hotels, developers, interior designers, and entities within the real estate and hospitality sectors, may use the artworks for presentation and marketing purposes within the spaces in which they are installed.
The condition for such use is proper attribution of the author:
Anna Kisicka-Turkuła / Anna Luxury Art
The sale of artworks is carried out exclusively by the Seller, unless otherwise agreed.
Partners may receive commission-based remuneration subject to individual agreements.
Limitations on Use
The purchase of an artwork grants the Customer the right to use the physical piece only.
Without prior consent of the Seller, the following are strictly prohibited:
– copying
– reproduction
– creating derivative products
– commercial use beyond standard presentation
Resale of the original physical artwork is permitted, provided that it does not infringe the artist’s copyright.

 
§18 Use of Artwork Images, Privacy and Location
The Seller reserves the right to present the artworks as completed projects, including in hotels, developments, and interior design environments.
Such presentation may include marketing materials, portfolio use, and sales communication.
Personal data of private clients remains confidential and is not disclosed.
In the case of installations in public or commercial spaces, the location may be referenced as part of the Seller’s portfolio.

 
§19 Customer Data
The Customer is responsible for the accuracy and completeness of the data provided.

 
§20 Force Majeure
The Seller shall not be liable for events beyond the Seller’s control.
This includes, but is not limited to:
– pandemics
– international conflicts
– transport disruptions
– administrative decisions
– logistical issues
Such circumstances may affect order fulfillment times.

 
§21 Limitation of Liability and International Sales
The Seller’s liability is limited to the value of the order.
The Seller shall not be liable for indirect losses, including but not limited to loss of profits.
The Customer is responsible for compliance with applicable laws in their country.
The Seller shall not be liable for import restrictions or additional legal requirements imposed in the Customer’s country.
In the event of any dispute arising from the sales agreement, the parties shall first seek to resolve the matter amicably.
If an amicable resolution cannot be reached, any disputes shall be governed by the law applicable to the Seller’s place of business and shall be subject to the jurisdiction of the competent courts of that jurisdiction, unless mandatory consumer protection laws provide otherwise.

By placing an order, the Customer expressly agrees to the immediate commencement of production, as each artwork is individually created upon order. Due to the custom-made nature of the product, the Customer acknowledges that the right of withdrawal is waived.

By using express checkout methods (including Apple Pay, Google Pay, or similar), the Customer acknowledges and agrees to these Terms & Conditions.
